Daytona Beach Motorcycle Accident Lawyer

Our Daytona Beach motorcycle accident lawyers understand both the joys that come with motorcycle riding in our sunny state, as well as the inherent risks.

Our Daytona Beach injury attorneys understand how important your bike is to you. We understand how serious injuries can occur from a motorcycle accident, especially if the victim was not wearing a helmet. If you or a loved one has suffered serious injury from a motorcycle accident or if you have lost a loved one, our motorcycle accident lawyers will fight to get you the compensation you deserve, and help you take care of medical bills and other expenses incurred because of the accident.

Riding a motorcycle can be dangerous. According to the U.S. National Highway Traffic Safety Administration (NHTSA), in 2006, 13.10 cars out of 100,000 ended up in fatal crashes. Motorcycles also have a higher fatality rate per unit of distance travelled when compared to automobiles. Per vehicle traveled, motorcyclists’ risk of a fatal crash is 35 times greater than a passenger car. Because motorcycle riders lack the weight, bulk and protection of a car, truck or SUV, they are more likely to sustain serious, life-altering injuries when accidents occur. Furthermore, unlike automobiles, motorcycles are not equipped with airbags, roofs, seat belts and other safety features.

We have experience helping clients with the following types of injuries:

  • Brain injury
  • Head injury
  • Neck injury
  • Road rash
  • Spinal cord injury
  • Back injury
  • Burns
  • Internal bleeding
  • Paralysis
  • Fractured or broken bones
  • Torn ligaments
  • Whiplash

Florida Motorcycle Helmet Laws

In Florida helmets are not required if you are over the age of 21. Per 316.211(b) Notwithstanding subsection (I), a person over 21 years of age may operate or ride upon a motorcycle without wearing protective headgear securely fastened upon his or her head if such person is covered by an insurance policy providing for at least $10,000 in medical benefits for injuries incurred as a result of a crash while operating or riding on a motorcycle.

Hiring a Daytona Beach Motorcycle Accident Attorney

At Bundza & Rodriguez, P.A., we understand the legal challenges facing motorcycle accident victims, especially if the case goes to a jury. Many car drivers simply do not understand the dynamics of a motorcycle. They tend to place blame on the motorcycle driver, assuming that he or she must have done something to contribute to the collision. Further, the opposing adjuster or attorney may attempt to unfairly blame the injuries on the lack of certain protective measures, such as a helmet.

The motorcycle accident attorneys at Bundza & Rodriguez, P.A. are here to help you recover the following damages:

  • Lost wages
  • Pain and suffering
  • Medical bills and expenses
  • Damage to your motorcycle
  • Loss of quality of your life
