Do we need to go through probate if there is a valid and non-contested will?

This is a very common question that we get and the answer is yes. Without going through probate, you will have no legal right to any of the property in the decedent’s estates. That means that you can’t get into bank accounts or transfer any ownership interest in any of that property. Generally speaking, yes, you have to go through probate.
