When Every Hour Counts: What Is Emergency Temporary Guardianship In Florida?

Urgent

A parent falls and hits their head. A grandmother with dementia wanders off and is found by a neighbor three streets over. A sibling discovers that a caregiver has started moving money out of mom’s account. What happens when someone you love needs protection right now, not in three months when a regular guardianship case might finally reach a hearing?

This is exactly the gap that emergency temporary guardianship is designed to fill. It is a fast, limited court process meant for situations where waiting simply is not an option.

What Makes a Guardianship “Emergency”

Under Florida Statute 744.3031, a court may appoint an emergency temporary guardian for the person, the property, or both, of someone who is alleged to be incapacitated, but only after a petition to determine incapacity has already been filed. The judge has to find that there appears to be imminent danger that the person’s health or safety will be seriously harmed, or that their property is at risk of being wasted, misappropriated, or lost, unless someone steps in immediately.

That word “imminent” matters. Courts are not handing out emergency authority for situations that are merely concerning or that could be handled through ordinary planning. They are looking for genuine urgency, the kind where a delay could cause real and lasting harm.

How the Process Moves So Quickly

Because lives and assets are on the line, the procedure is intentionally compressed. Notice of the petition and the hearing generally has to be given to the alleged incapacitated person and their attorney at least 24 hours beforehand, although a judge can shorten that window if waiting would cause substantial harm. The court also appoints an attorney to represent the person at the center of the case, since their rights are very much still in play even during an emergency filing.

So who typically asks a court for this kind of authority, and what can they actually do once appointed? In practice, the people who file are usually:

  • Adult children worried about a parent’s safety or finances
  • Spouses dealing with a sudden medical crisis
  • Concerned friends or neighbors with firsthand knowledge of the danger
  • Healthcare providers or facility staff who have witnessed neglect or exploitation

Once appointed, an emergency temporary guardian’s powers are not unlimited. The court spells out exactly what the guardian may and may not do, and that authority generally lasts only 60 days, with the possibility of a 30 day extension if the emergency conditions are shown to still exist.

It Is Temporary by Design

An emergency temporary guardianship is meant to bridge a gap, not replace the full guardianship process. While it is in place, the underlying petition to determine incapacity continues moving through the court, complete with an examining committee evaluation and, eventually, a hearing. Once that process concludes, the emergency guardian’s role ends, either because a permanent guardian takes over or because the court determines that guardianship is not necessary after all. The emergency guardian must also file a final report within 30 days after the emergency authority expires, accounting for everything done during that window.
