How is a guardianship proceeding initiated?
The guardianship can be initiated by any interested person within the ward’s life. What that person does is they file a petition to determine incapacity with the court system. The judge will then impanel a panel of three people to examine the perspective ward, and they will also order a court appointed attorney to fight for the rights of that ward.
